IPD Analytics, LLC (“IPD”) respects the privacy rights of our users and is strongly committed to protecting users’ privacy. This Privacy Policy (“Policy”) is in effect as of the date set forth above, and applies to information processed through IPD’s website, mobile applications, or other places where this Policy is posted (collectively, "Site") about users of the Site and the information processed through our research activities such as interviews and online surveys (together, “Surveys”). The Site and Surveys are collectively referred to herein as the “Services.”

 

By visiting, accessing, or using our Services, users acknowledge our collection, use, storage, disclosure, transfer and other processing of user information as described in this Policy.

Information We Collect

 

IPD collects information that identifies, relates to, describes, and/or is reasonably capable of being associated with a particular person or device. We collect information from or about a user in several different ways. Specifically, we collect information: (1) directly from the user through information the user provides; (2) automatically through technology as a user uses the Services; and 3) from third parties such as data analytics providers. Each of these means of collection are discussed in more detail below.

Information We Collect from Users Directly

 

First, IPD collects information that users provide, such as when a user registers for our Services, if a user submits a webform to learn more about our Services, when a user requests certain Services, or when a user participates in our Surveys.  This information may include the user’s name, phone number, email address, job title, employer, including audio recordings of user interviews, and any other information a user provides.

Information We Collect from Users Automatically

Second, IPD also collects information about a user’s device, network, and activities through cookies, web server logs, tracking pixels, and similar technologies. A web server log is a file where website activity is stored. Tracking pixels (sometimes referred to as “web beacons” or “clear GIFs”) are electronic tags with a unique identifier embedded in website, online ads and/or email, and are designed to provide usage information like ad impressions or clicks, measure popularity of the Site and associated advertising, and access user cookies. A cookie is a small text file placed on a user’s computer or mobile device as the user navigates websites. We refer to these technologies that automatically collect user information through the Services as “Cookies.”

 

Most browsers are set to accept Cookies by default. A user can usually change user browser settings to disable or remove Cookies, or to alert the user when Cookies are being set. The “Help” function on most browsers contains instructions on how to set a browser to notify the user before accepting Cookies or to disable Cookies entirely. However, certain features of the Services may not function properly if the user disables or removes Cookies.

 

IPD may use Cookies to collect information about a user’s use of the Services, such as the user’s IP address, browser type, language, operating system, computer platform, and the state or country from which the user accessed our Services. IPD may also use Cookies to collect and compile statistical and other information about a user’s use of the Services, such as the web pages visited, the date and the time of the user’s visit, the websites the user visited immediately before and after visiting the Services, the number of links the user clicked within the Services, the functions the user uses on the Services, the databases the user views and the searches the user requests on the Services, and the data the user saves on or downloads from the Services.

 

We may use four primary types of Cookies:

  • Strictly Necessary Cookies – These Cookies are necessary for the Services to be able to function. For example, strictly necessary Cookies allow a user to log in to the user's account with the Services.

  • Functional Cookies – These Cookies support the use of the Services and enable certain features to personalize the user's experience. For example, functional Cookies allow the Services to remember a user's preferences when using the Services.

  • Performance Cookies – These Cookies collect information needed to support the Services and our applications and allow us to identify problems and improve the Services – for example, performance Cookies help us count page visits or analyze loading speeds of pages on the Services.

  • Analytics Cookies – These Cookies help us learn more about the user's interactions with the Services to improve the user's user experience. For example, these Cookies may help us learn more about how a user came to our Services and how the user navigates through the Services.

Information We Receive from Third Parties

We may receive anonymized or aggregate information from third-party providers to develop insights that we offer to customers. This information is not identifiable and is therefore not subject to this Policy.

How We Use User Information

 

IPD uses a user's information for the following purposes:

 

  • to operate and provide our Services;

  • to communicate with the user;

  • to complete user payments and transactions;

  • to help IPD improve our Services and develop new Services;

  • to provide assistance and support for our Services, and for IPD internal quality control purposes, including through vendor tools;

  • to provide the user with updates, offers and promotions about IPD’s Services and products that may be of interest to a user;

  • to personalized and enhance a user's experience with the Services, including to save a user's preferences and login information, perform account authentication, and send account notifications;

  • to analyze use of the Services;

  • to protect a user's security, e.g., preventing and detecting fraud;

  • to protect the interests, rights, safety, or property of IPD or others and to monitor compliance with and enforce any legal obligations or the terms of any agreement with IPD.

 

We aggregate or deidentify information we have collected about a user through the Services for any purpose and such information may be disclosed in our discretion.

 

Our Disclosure of User Information

 

Disclosure to Affiliates and Related Businesses

IPD may disclose a user’s information to our affiliates and subsidiaries for the purposes set forth in this Privacy Policy.  

 

Disclosure to Vendors

 

IPD may disclose user information to vendors who may help us provide the Services, including to:

 

  • Provide billing and collection services;

  • Provide the user with updates, offers or promotions from IPD;

  • Operate systems that provide the Services;

  • Provide audio transcription, data storage, and analysis services.

Disclosure for Legal Purposes

IPD may also disclose user information to unaffiliated third parties if we believe in good faith that such disclosure is reasonably necessary to: (a) comply with any applicable law, rule or regulation or in response to a subpoena, court order, or other legal process; (b) respond to a lawful request by a government authority, law enforcement agency or similar government body; (c) protect the interests, rights, safety, or property of IPD or others, which may include exchanging information with other organizations for fraud prevention and detection; (d) monitor compliance with and enforce any terms of service or other agreement related to the Services; or (e) disclose and/or transfer data to another entity to conduct due diligence or otherwise disclose information in connection with an acquisition or merger with another company, if IPD sells or transfers a business unit or assets to another company, as part of a bankruptcy proceeding, or as part of any other similar business transfer.

IPD does not sell or rent personal information collected by our Services to third parties.

Legal Basis for Processing

In some jurisdictions, such as in the EEA, UK, and Switzerland, we must have a legal basis to process users’ personal data. Where required, we process personal data on the following legal bases: (1) as necessary to perform our agreement to provide the Services to users; (2) as necessary for our legitimate interests in providing the Services where those interests do not override a user’s fundamental rights and freedoms related to privacy; (3) as necessary to comply with a legal obligation; or (4) with a user’s consent.

Security and Retention of User Information

 

Information about our users collected by IPD through the Services is maintained on secure servers.  IPD uses security measures appropriate to the provision of the Services, such as reasonable administrative, technical, personnel, and physical measures to protect this information on such servers. We cannot guarantee that these measures will prevent every unauthorized attempt to access, use, or disclose a user’s information. 

 

Information is retained for as long as is necessary for the purpose for which it is collected, including legitimate business reasons and/or legal and regulatory requirements. Our retention is based upon the amount, nature and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure of the information, the purposes for which we process the information, applicable legal requirements, and our legitimate interests. The purposes for which we process information may dictate different retention periods for the same types of information. For example, we retain user email address as an authentication credential (where applicable) as long as user has an account with us and an additional period of time after that for our legitimate interests and for our fraud and legal compliance purposes. We may delete or de-identify your information sooner if we receive a verifiable deletion request, subject to exemptions under applicable law.

 

Rights with Respect to User's Information

 

A user may log in to our Site to update the user's registration or account information.  

 

Depending on the jurisdiction in which the user resides, including the EEA, UK, Switzerland, or California, the user may have rights to access, correct, delete, or restrict use or processing of certain information collected about the user through the Services. To submit a request, a user can:

  • Call us at 866-449-6782.

  • Email us at privacy@ipdanalytics.com – with the user’s name, state (if in the United States) or country (if outside of the United States) of residence, telephone number, and type of request (that is, a request for access, correction, restriction, and/or a request to delete).

 

We may ask for additional information from the user to verify the user’s request.

 

Please note that if a user exercises any rights to delete or to restrict information use or processing this may affect our ability to provide our Services.  While IPD will make reasonable efforts to accommodate your request, IPD may retain certain information or continue processing certain information as permitted under applicable law.  Please note that it may take some time to process the user’s request, consistent with applicable law.

 

In certain jurisdictions, user may also have the right to lodge a complaint with user’s local data protection authority if user believes we have processed user’s personal information in violation of applicable data protection law.

 

Responses to Requests. We will confirm receipt of a user’s request and respond to the user’s request within the timeframes required under applicable law.  If we need more time to respond, we will inform the user of the reason and will respond within the legally required timeframe.

 

Transfer of User Information to Other Countries

 

Some of the uses and disclosures mentioned in this Privacy Policy may involve the transfer and processing of a user's information collected through the Services to and in various countries that may have different levels of privacy protection than a user's country of residence. We will implement appropriate safeguards to govern transfers of personal information where required under applicable law. By using our Services, the user consents to such transfers and processing, including to and in the United States.

Information from Children

IPD’s Services are not intended for children, and the Services are not directed to individuals under the age of 18. Children under 18 years of age, may use the Services only with the involvement of a parent or guardian. If we discover we have processed any “personal information” (as defined under the Children’s Online Privacy Protection Act) from a child under the age of 18 in violation of this Privacy Policy, we will take reasonable steps to delete that information as quickly as possible. If a user believes IPD has any information from or about anyone under the age of 18, please contact us via mail or email at the addresses listed below.

Third-Party Sites

The Services may link to or embed content from third-party websites and services that are outside of our control. We are not responsible for these third parties’ practices, and this Policy does not govern those third parties’ content, services, or use of your information.

Changes to This Privacy Policy

 

IPD reserves the right to change this Privacy Policy at any time by posting revisions on this web page. Such changes will be effective upon posting.

California Residents' Rights

The California Consumer Privacy Act (CCPA), California’s “Shine the Light” law, and the California Online Privacy Protection Act provide consumers who are California residents with specific rights regarding their personal information.  If a user is a California resident, this section provides you with additional information, describes the user's rights and explains how to exercise those rights.

In the twelve (12) months preceding the Last Updated date of this Policy, we have collected or received the following categories of personal information about California residents.

Parties to Which We Disclose This Information

We disclose any of the above categories of information we collect to: our affiliates; business partners to provide users with the Services they request; service providers; other parties, including government entities, when required by law or to protect our users and Services; and with user’s consent or in connection with a corporate transaction.

We disclose commercial information to service providers.

We disclose internet or other similar network activity with entities that provide content and functionality.

User Requests for California Residents

Right to Access Information.  Subject to certain limits, users may ask us to provide the following information:

 

  1. The categories of personal information we collected about a user;

  2. The categories of sources from which the personal information was collected;

  3. The business or commercial purpose for collecting the personal information;

  4. The categories of third parties with whom we shared the personal information;

  5. If we disclosed personal information for a business purpose, the categories of personal information disclosed and the categories of persons to whom it was disclosed; and

  6. The specific pieces of personal information we collected about users.

 

Right to Delete.  A user also has the right to ask us to delete any personal information that we have collected about the user, subject to certain limitations as set forth under CCPA. We may deny a user's deletion request if the information in scope is exempt from deletion under applicable law, such as information we retain for legal compliance and to secure our Services.

Right to Correct User Information. A user has the right to correct inaccurate information we retain about the user.

Right to Opt Out of the Sale or Sharing of Personal Information. The CCPA allows a user to opt out of the processing of personal information that constitutes a “sale” or “sharing” of such information under the law. IPD does not engage in processing that is considered a “sale” or “sharing” under the CCPA.

Right to Limit the Use of Sensitive Personal Information. The CCPA also allows a user to limit the use or disclosure of a user’s “sensitive personal information” (as defined in the CCPA) if the user’s sensitive personal information is used for certain purposes. Please note that, in the limited circumstances we process sensitive personal information as defined by the CCPA, we do not use or disclose it other than for disclosed and permitted business purposes for which there is not a right to limit under the CCPA.

Right to Nondiscrimination. We will not discriminate or retaliate against a user for exercising a user’s privacy rights under California law.

However, the CCPA permits us to offer users certain financial incentives that can result in different prices, rates, or quality levels, which are related to the value of a user’s personal information.  Participation in a financial incentive program requires a user’s prior opt-in consent, which a user may revoke at any time.  We do not offer financial incentives at this time.

Shine the Light. Once a year, California residents can also request certain information regarding our disclosure, if any, of certain categories of personal information to third parties for their direct marketing purposes in the preceding calendar year. We do not disclose users’ personal information with third parties for their own direct marketing purposes.

Do Not Track. “Do Not Track” is a privacy setting that users can set in certain web browsers.  If turned on, this setting requests that websites not track information about users.  At this time, we do not respond to “Do Not Track” browser settings or signals.

Submission of Requests for Access, Correction, or  Deletion.  If a user is a California resident, the user may submit a request for information or a request to delete by:

  • Calling us at 866-449-6782; or

  • Emailing us at privacy@ipdanalytics.com – please provide the user’s name,  and type of request (e.g., a request for categories of information, a request for specific pieces of information, a request to correct, and/or a request to delete).

Verifying a User’s Identity. We may need to request specific information from the user to help us confirm the user’s identity and ensure the user’s right to exercise the rights offered under California law. For example, if a user makes a request, we may need to confirm user’s name, email address, and/or other information we in our records to verify a user’s identity. Only the user or someone legally authorized to act on the user’s behalf may make a verifiable request related to a user’s personal information.

Requests from Authorized Agents. Users may designate an authorized agent to make a request for the user.  If a user designates an authorized agent to make a request on the user’s behalf, we may require the user to verify the user’s identity and provide the authorized agent’s identity and contact information to us.

No Fee Usually Required. A user will not have to pay a fee to exercise any of the user’s rights. However, we may charge a reasonable fee if a user’s request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with a user’s request in these circumstances.
